Compensation standard for loss and damage of library materials

Latest Revised and Passed by the Library and Information Technology Committee on May 21, 2012

Section 1. In maintaining the integrity of the library's materials and readers' rights and interests, this standard is specially formulated by the provisions of the library borrowing rules.

Section 2. The "book materials" referred to in this standard refer to all books and non-book materials kept in the library. If the readers lose or damage the material, such as scribbles, annotations, stains, dog-eared, tears, etc., they should pay compensation under this standard.

Section 3. The loss or damaged material is subject to the principle of compensation for books and materials. If the material cannot be purchased, the settlement will be made in cash according to the provisions of this standard.

Section 4. When a reader loses or defaces a book, immediately report the loss to the Office of the Library and Information Technology (referred to as LIT) Division of Circulation and fill in the compensation procedure form. For book compensation, published materials in Taiwan should complete the compensation procedures within two weeks after reporting the loss; for published materials in other regions, the compensation procedures should be completed within three months after reporting the loss. Individuals reporting the loss of books after the expiration date or failing to meet the compensation procedures within the prescribed time will be subjected to Section 7 of the Book Borrowing Rules, and an overdue fine will be added.

Section 5. Compensation principle:

  1. Materials offset:
  1. Lost hardcover copies cannot be compensated in paperback copies.
  2. Books (including series or sets of books) or periodicals shall be offset against the new ones with the same edition. Suppose it is no longer possible to purchase the same edition of the books or periodicals, with the consent of the library, the new edition books/periodicals or old books/periodicals with the same edition can be used as compensation.
  3. Compensation materials must comply with the provisions of the Copyright Law and should not contain scribbles, annotations, stains, dog-eared, tears, etc.
  4. Audio-visual materials shall be compensated with legal public broadcast version materials.
  5. Compensation for reprinted dissertations should comply with the Copyright Law.
  6. The book annex should be compensated with the original edition, and if it is a new edition, it should be compensated with the new book.
  7. Bound journals are subject to a binding fee.

2. Cash compensation (with the price to follow)

  1. Books or periodicals published in Taiwan should be compensated twice the fixed price.
  2. Books or periodicals and all audio-visual materials published in other regions are calculated at twice the original purchase price (not less than the amount purchased at that time in New Taiwan Dollars).

3. Cash compensation (for those with no price to follow):

  1. Books or Periodicals: The cost is calculated by the number of pages. Books or periodicals published in Taiwan are charged NT$3 per page, and those published in other regions are charged NT$10 per page. If the number of pages is less than 100, it will be counted as 100 pages; if the number of pages is unknown, it will be estimated as 300.
  2. Audio-visual materials: each piece of audio recording is priced at NT$1,000; video materials and computer discs are priced at NT$3,000 for domestic and NT$5,000 for foreign publishers. For other types of audio-visual materials, compensation shall be made according to their value.
  3. The thesis will be compensated with NT$1,000.

4. If more than one volume (piece) of a series or set of books or a complete set of audio-visual materials is lost or damaged, the original book should be purchased for compensation. If the materials cannot be purchased individually, the price of the series or the complete set of audio-visual materials will be calculated and compensated. However, after the compensation obligor makes compensation, it cannot claim the rights to the remaining books or copies of the complete set of books and audio-visual materials.

5. Compensation for books such as special editions (including rare books) and art albums will be handled case-by-case after expert appraisal.

Section 6. This standard is issued and implemented after it is approved by the Library and Information Technology committees.
